Terms and Conditions
1. Payment
Payment must be received by cheque and cleared or credit card and processed before commencement of manufacture. For orders of more than £1000 we require 50% deposit, the balance payable prior to despatch. The maximum fulfilment time will not start until payment has cleared and Title will remain with Mytilesmyhome Ltd until full settlement.
2. Copyright
Most Mytilesmyhome Ltd images are in the Public Domain and are not subject to copyright restrictions. However we have to obtain image rights and will only use images where these have been obtained. If you supply images for reproduction you are responsible for all copyright issues concerning use of the image. We will not reproduce any images where we suspect the copyright may be violated. By agreeing to these terms and Conditions you are indemnifying Mytilesmyhome Ltd against any legal proceedings resulting from our unknowing breach of copyright as a result of your misrepresentation of ownership.
3. Returns and Refunds
As each mural is personalised and made to your specification we are exempt from the Cancellation terms of the Consumer Protection Distance Selling Regulations from the DTI. However we will try to help and may refund up to 50% of the cost at our discretion. You are responsible for the cost of returning goods to us in what we judge to be resalable condition.
4. Limited Liability
Check all products prior to installation, as any claims cannot be considered once the products have been installed. Mytilesmyhome Ltd is not responsible for inappropriate use of its products. Mytilesmyhome Ltd does not accept any liability for faulty installation of tiles supplied by them. For claims concerning the tiles themselves our liability is limited to the purchase price of the product, it does not include consequential loss.
5. Finished Product Specifications
Mytilesmyhome Ltd will endeavour to produce murals as close as possible to your specifications in terms of colour matching, cropping and enlargement. Without adequate specification, we will use our best professional expertise and judgement. Please provide a fully marked up printout if you have a particular specification in relation to your order.
6. Damaged Goods
We are not responsible for damage, which occurs due to the actions of delivery services, after the goods leave our premises. If any tiles arrive damaged you must inform us within 24 hours quoting the order number on any correspondence. We will reprint them and ship them at our expense. You must keep the damaged items and packaging for the shipper’s inspection, as we will make an insurance claim with the shipper. If the packaging is damaged on delivery please record this on the delivery note.
7. Extra Shipping Charges
You, as the client are responsible for any duties and/or taxes levied at the point of entry into a country outside the United Kingdom.
8. Warranty
Mytilesmyhome Ltd warrants that its tiles conform to their description and are fit for their purpose. We make no other express or implied warranty as to fitness or merchantability. We extend no guarantees, express or implied, as to longevity, durability or care operations.
9. Legal Jurisdiction
Any contract between Mytilesmyhome Ltd and the client will be governed and constructed according to English Law and each party hereby submits to the jurisdiction of the English Courts.
10. Trading Name
